On May 28, 1964, the relators filed a petition for leave to commence an original action for an injunction and mandamus grounded upon the unconstitutionality of sec. 59.03 (2), Stats. After oral arguments, this court on June 10, 1964, granted leave to the relators to commence an original action for declaratory judgment and appropriate supplementary relief. The petition was deemed to constitute a complaint and an application to this court to declare sec. 59.03 (2) unconstitutional as applied to future elections of county boards in all counties of Wisconsin excepting Milwaukee and Menominee.
